Where to file

Maricopa County Superior Court handles all divorce filings. You can file at any of these locations:

Downtown Phoenix (main courthouse) 201 W. Jefferson St., Phoenix, AZ 85003 (602) 372-5375

Southeast Facility (Mesa) 222 E. Javelina Ave., Mesa, AZ 85210

Northwest Regional Center (Surprise) 14264 W. Tierra Buena Lane, Surprise, AZ 85374

You can file at any location — you do not need to go to the facility closest to your home. The downtown Phoenix courthouse has the most staff and resources for self-represented filers, including the Self-Service Center.

If you have questions about the process or need help understanding a form, the Maricopa County Superior Court Self-Service Center (located in the downtown Phoenix courthouse) provides free assistance to self-represented litigants.

Staff can help you understand what forms you need and how to file them correctly. They cannot give legal advice about what terms to put in your decree or how to negotiate with your spouse. But for procedural questions, the Self-Service Center is a useful resource.

Filing fees

Current Maricopa County filing fees:

  • Petition for Dissolution of Marriage (petitioner's fee): $349
  • Response to Petition (respondent's fee): $274

These fees are paid at the clerk's office when you file. Maricopa County accepts cash, money order, and most credit and debit cards.

If your income qualifies, you can apply for a fee waiver or deferral at the time of filing. Ask the clerk for the application.

Serving your spouse in Maricopa County

After filing, you must serve your spouse with the divorce papers. Your options in Maricopa County:

Acceptance of Service. Your spouse signs an Acceptance and Consent to Jurisdiction form, acknowledging they received the documents. This is free and eliminates the need for a process server. If your spouse is cooperative, this is the simplest path.

Private process server. A licensed process server delivers the documents to your spouse directly. Typical cost in Maricopa County is $75 to $150. Find licensed process servers through the Arizona Registrar of Contractors or an online directory.

Maricopa County Sheriff. The sheriff's office provides service for a fee. Contact the Civil Process Unit for current pricing and procedures.

After service is complete, you file proof of service with the court (or the signed Acceptance of Service form). The 60-day waiting period begins on the date of service.

The Parent Information Program (if you have kids)

Maricopa County requires both parents to complete a court-approved Parent Information Program before finalizing a divorce involving minor children. The program is typically completed online or in a 3 to 4-hour session.

Maricopa County-approved providers include several nonprofits and online services. Fees are generally $30 to $60 per person. You each complete it separately and file your certificates with the court.

Do not wait until the last minute to complete this. Some providers have scheduling lead times.

Maricopa County-specific tips

Do not confuse city courts with the Superior Court. Divorce filings go to Maricopa County Superior Court, not the City of Phoenix Municipal Court or any other city court.

Processing times. Maricopa County handles the highest volume of family law cases in Arizona. After you submit your final decree package, allow 2 to 4 weeks for the judge to review and sign. This is normal and does not indicate a problem.

No in-person hearing for most uncontested cases. Many uncontested Maricopa County divorces are finalized on paperwork alone. If a hearing is required, you will receive notice from the court.

Certified copies. After your decree is signed, you can request certified copies from the clerk for $25 to $30. You will need them for updating financial accounts and name change records.
